I can get some of the sitemap_x.xml.gz files to chmod to 777 and others won't.... why is that?
I have tried using the cpanel file manager and FlashFXP i even went into the WHM to try to change them, no luck there either

You can try to remove sitemap files and renerate them.

I copied them then deleted them then re uploaded them and they did chmod right thanks
You should not chmod them if they were created by sitemap generator.

only the containing FOLDER needs to be writable.
