For a domain change, you seem to do be doing reasonably well on the re-indexing.

Note: Google's estimate of pages indexed will change quite often. Do not let minor fluctuations bother you. Of course, the best metric of your progress is your actual Web page hits.

I don't think you're being penalized. However, a domain change is a significant factor, and it probably will take some more time to get back to previous levels.
